About National Apprenticeship Compliance

Why Apprenticeship Compliance Matters Who Must Comply

As per the Apprentices Act (as amended), establishments in India with 30 or more employees (including contract staff) are mandated to engage apprentices in a range of 2.5% to 15% of their total workforce. Compliance helps organisations avoid penalties and support national skill development objectives.

National Apprenticeship Training Scheme (NATS)

Purpose:
NATS focuses on on-job training for fresh graduates, diploma holders, and vocational trainees to bridge academic knowledge with practical industry experience. Training durations typically range from 6 months to 1 year depending on qualification and job requirements.

Key Requirements & Benefits:

  • Helps fulfil mandatory Apprentice Act obligations.
  • Government reimbursement of up to 50% of stipend, subject to a maximum (e.g., ₹4,500 per apprentice per month).
  • Stipends to be paid to apprentices no need to have any statutory components like PF, ESIC etc.
  • Apprentices are exempt from PF/ESIC statutory components.
  • Stipend costs can be classified as CSR expenditure.

Penalties for Non-Compliance:

Failure to adhere to the Act’s apprenticeship requirements can result in fines — increased over time until seats are filled.

National Apprenticeship Promotion Scheme (NAPS)

Purpose:
NAPS incentivises employers to engage apprentices by co-sharing stipend costs with the Government.
Scheme Benefits:

  • Government reimbursement of 25% of the prescribed stipend, up to a cap (e.g., ₹1,500 per month per apprentice).
  • Reduced recruitment cost and time.
  • Eligibility for CSR accounting and exemption from PF/ESIC norms for apprentices.

Who Can Benefit:
Organisations of various sectors (IT, manufacturing, services, etc.) that deploy apprentices under designated or optional trades benefit through financial incentives and skilled talent pipelines.
